Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the NutriText AI mobile application and related services (collectively, the "Service"), operated by APPCODE S.R.L. ("we", "us", or "our"), a company registered in Romania.

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are in the European Economic Area, you must be at least 16 years old. If you are under the applicable age of consent, your parent or legal guardian must review and accept these Terms on your behalf.

By using the Service, you represent that you meet these eligibility requirements.

3. Accounts

You may sign in using Google or Apple OAuth. You are responsible for maintaining the confidentiality of your account and for all activity under your account.

You may delete your account at any time through the app's Settings screen. Upon deletion, your personal data will be permanently removed from our systems, subject to our Privacy Policy.

4. Subscriptions and Payments

4.1 Tiers

The Service offers the following tiers:

  • Free/Basic — up to 10 recipes per day and 20 nutrition analyses per day
  • Pro — up to 20 recipes per day, 50 nutrition analyses per day, AI meal planner, micronutrient deep-dive, and AI Smart Swaps

4.2 Subscription Management

Pro subscriptions are managed through the Apple App Store and Google Play. All billing, renewals, and cancellations are handled by the respective store's payment system. We do not process or store payment card information.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your App Store or Google Play account settings.

4.3 Refunds

Refund requests are handled by Apple or Google in accordance with their respective policies. Please contact the appropriate store for refund inquiries.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to circumvent rate limits, access controls, or other usage restrictions
  • Submit false, misleading, or abusive content through the Service
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use automated means (bots, scrapers, etc.) to access the Service without our express permission
  • Interfere with the operation of the Service or impose an unreasonable load on our infrastructure

6. AI-Generated Content

The Service uses artificial intelligence to analyze recipes and generate nutritional information, meal plans, and ingredient suggestions. You acknowledge that:

  • AI-generated nutrition data is for informational and educational purposes only and is not a substitute for professional medical or dietary advice
  • Nutrition values are estimates and may not be accurate for all specific ingredients, preparation methods, or individual health conditions
  • You should consult a qualified healthcare professional before making dietary decisions based on the Service
  • We are not liable for any decisions or actions you take based on AI-generated content

7. User Contributions

When you submit ingredient corrections, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, store, and incorporate those corrections into our nutrition reference database in anonymized form. This helps improve the accuracy of the Service for all users.

You represent that any corrections you submit are accurate to the best of your knowledge.

8. Intellectual Property

The Service, including its code, design, branding, and proprietary nutrition reference data, is the property of APPCODE S.R.L. and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from the Service without our prior written consent.

9. Third-Party Services

The Service integrates with third-party services including Google OAuth, Apple Sign-In, Google Gemini, OpenAI, RevenueCat, and Hetzner. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the operation of these third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL NUTRITION DATA IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPCODE S.R.L. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF €50 OR THE TOTAL AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or our operations.

Upon termination, your right to use the Service will immediately cease. Sections 7, 8, 10, 11, and 13 shall survive termination.

13. Governing Law

These Terms are governed by the laws of Romania. Any disputes arising from these Terms shall be resolved by the courts of Romania.

If you are a consumer in the European Union, nothing in this section affects your statutory rights under EU law, including the right to bring proceedings in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
